Montreal (QC), Canada – A Quebec Court of Appeals Judge on Wednesday ordered a Laurentian ski area to pay C$4.1 million to the victim of a 2003 ski accident.

n”The ski school breached its obligation to provide safe supervision,” Judge Nicholas Kasirer wrote upholding an earlier judgment against Saint-Sauveur International, operators of Mont Olympia.

Mathew Armutlu was 9 years old in 2003 when he lost control on a novice slope and ran off into the woods, crashing on rocks with sufficient force to crack his helmet. Armutlu suffered permanent brain damage in the incident. His instructor had moments earlier sent Armutlu down the slope alone, leading to the finding of negligence against the ski area.

According to the decision, Armutlu, now 16, is no longer able to make informed decisions for himself. The injury is reportedly severe enough to prevent driving a car or attending university.

Saint-Sauveur International has 60 days to decide whether or not to appeal the decision to the Supreme Court of Canada.
