District Attorney Considers Filing Charges in Aspen Skiing Death

Aspen, CO – The Pitkin County Sheriff’s office on Friday completed its investigation into last week’s death of 48-year-old Pennsylvanian Nancy Egleston in a skier collision on the slopes of Aspen Mountain, and the county’s District Attorney is now considering charges against the other  skier involved in the accident, 53-year-old Virginia Chen of New York City.

Ninth Judicial District Attorney Sherry Caloia told the Aspen Times newspaper that her office expects to reach a decision this week on whether or not to file charges under the Colorado Skier Safety Act, which reads in part, “Each skier has the duty to maintain control of his speed and course at all times when skiing and to maintain a proper lookout so as to be able to avoid other skiers and objects. However, the primary duty shall be on the person skiing downhill to avoid collision with any person or objects below him.”

Witness accounts indicate that Egleston, of Ardmore, Penn., stopped on Aspen’s intermediate Spar Gulch run just above the intersection with Bingo Slot, possibly to clean her goggles, when the collision occurred. Chen had been descending Copper Bowl before merging onto Spar Gulch.

The Pitkin County Coroner’s Office determined that Egleston died of a traumatic brain injury. She also sustained fractured ribs in the collision. Chen sustained only minor injuries. Both women were reportedly wearing a helmet at the time of the occurrence.
