Windham Mountain Skier Death Prompts Lawsuit

Windham, NY – The family of Matthew Falco has filed a wrongful death lawsuit against Windham Mountain, following the Staten Island resident’s death on the slopes of this Catskill ski resort in 2012.

On Feb. 4, 2012 Falco, 53, lost control and crossed a culvert before striking an embankment alongside the ski resort’s intermediate Upper Warpath run just above its intersection with the Wall Street trail. The victim, who was employed as an NYPD forensic analyst, was pronounced dead at the scene.

According to his wife, Karan Falco, her husband was an experienced skier. Karan Falco has now sued Ski Windham Operating Corp. in New York State Supreme Court, alleging that her husband’s death resulted from the hazardous design and negligent maintenance of the Upper Warpath trail.

In January 2011, an 18-year-old woman struck a tree and died at Windham Mountain, also on the Upper Warpath trail.
